2Fundamentals
We only collect personal data to the extent necessary for the operation of this shop: to fulfill an order, to answer an inquiry and to provide the website technically.
We do not sell data and do not pass it on to third parties for advertising purposes.
3Hosting: Shopify
This shop is operated on the platform of Shopify International Limited (Victoria Buildings, 1–2 Haddington Road, Dublin 4, D04 XN32, Ireland).
Shopify processes data collected during website visits and the ordering process on our behalf. This is based on a data processing agreement according to Art. 28 GDPR.
Data transfer to third countries takes place based on the EU standard contractual clauses. Further details can be found in Shopify's privacy policy: shopify.com/legal/privacy
4Server-Logfiles
When you access this website, information that your browser transmits is automatically collected: browser type and version, operating system used, referrer URL, time of the request and the IP address in a shortened form.
This data is technically necessary to deliver the page and to ensure its stability and security. The legal basis is Art. 6 para. 1 lit. f GDPR (legitimate interest). A merging with other data sources does not take place.
5Order and Contract Processing
For an order, we process the name, delivery and billing address, email address, and information about the chosen payment method.
The legal basis is Art. 6 para. 1 lit. b GDPR (performance of a contract). The data will be passed on to the shipping company and the payment service provider, insofar as this is necessary for delivery and payment processing.
Commercial and tax law retention periods remain unaffected: We retain invoice data for up to ten years in accordance with § 147 AO and § 257 HGB.
6Payment service provider
Payment processing is handled by the providers offered during the order process (e.g., Shopify Payments, PayPal, Klarna).
Your payment data — such as full card numbers — is collected and processed directly by the respective provider; we do not receive it. The data protection provisions of the respective provider also apply.
The legal basis is Art. 6 para. 1 lit. b GDPR.
7Contact
If you write to us via the contact form or by e-mail, we process the information you provide in order to answer the request.
The legal basis for this is Art. 6 para. 1 lit. b GDPR, if the request concerns a contract, otherwise Art. 6 para. 1 lit. f GDPR (legitimate interest in answering the request).
The enquiries will be deleted as soon as they have been dealt with and there are no retention obligations to prevent this.
8Customer Account
You can create a customer account, but you don't have to — you can also place an order as a guest.
If you create an account, we will save the information stored there so that you do not have to enter it again. The legal basis is Art. 6 para. 1 lit. b GDPR.
You can have your account deleted at any time. To do so, please send us a short message.
9Newsletter
If you subscribe to the newsletter, we will only use your e-mail address for this purpose. The registration is done by a double opt-in procedure: You will first receive an e-mail asking for confirmation.
The legal basis is Art. 6 (1) (a) GDPR (consent). You can revoke your consent at any time – via the unsubscribe link in every e-mail or by sending us a message. The legality of the processing carried out until revocation remains unaffected.
10Cookies
This website uses cookies. Technically necessary cookies – for example for the shopping cart and the session – are required for the shop to function; the legal basis for this is Section 25 (2) TTDSG in conjunction with Art. 6 (1) lit. f GDPR.
We only set cookies that are not technically necessary with your consent in accordance with Section 25 (1) TTDSG and Art. 6 (1) lit. a GDPR. You can revoke your consent at any time.
You can delete cookies or restrict their storage via your browser. If necessary cookies are blocked, the order process cannot function completely.
11Your rights
You have the following rights regarding your personal data:
- Right of access (Art. 15 GDPR)
- Right to rectification (Art. 16 GDPR)
- Right to erasure (Art. 17 GDPR)
- Right to restriction of processing (Art. 18 GDPR)
- Right to data portability (Art. 20 GDPR)
- Right to object to processing (Art. 21 GDPR)
- Right to withdraw consent (Art. 7 para. 3 GDPR)
An informal message to info@34devs.com is sufficient.
12Right to lodge a complaint with a supervisory authority
You have the right to lodge a complaint with a data protection supervisory authority about the processing of your personal data (Art. 77 GDPR).
The competent authority is the State Commissioner for Data Protection and Freedom of Information North Rhine-Westphalia, Kavalleriestraße 2–4, 40213 Düsseldorf, Germany.
